It CAN.

It most likely isn't. But the problem for the prisecution is unless they prove that it COULDN'T be true, then they'll have trouble proving him guilty.

cant see the prosecution doing much when they have basically been torn to shreds ....can his version of events be true ??  this shits addictive 

 

The prosecution have come across poorly, and the investigator appears to have formed a view and then looked for things which support that view.  While this may be how police often behave, it's not what they are meant to do.

 

However, it's not the trial, and on lots of points which the defence are raising (like not knowing whether the supposed witness was 300 or 600 metres away, not having required the phone company to produce the record of calls pronto rather than when the bloke asked to do it gets round to it), perhaps they weren't expecting to have to go into this level of detail at a bail hearing.

Yes, there are a number of things that need to be followed up, like the phone records or the bullet angles or the witness statements etc.

If just one of them contradicts his story it will look very bad for him.

Roux said earlier that the trajectory of the shots was consistent with OP's story. A point conceded by the prosecution. The rozzers have been made to look like proper chumps on the witness statement and the fact that hey still don't have the phone records yet.

So far following it ...the cricket bat was not used to hit her with , the bullet angles go with op side of events ...he brought her downstairs and made an attempt to keep her alive until the emergency services got there ....and this is the bail hearing ....This never happened in my cousin vinny

Maybe I'm about to give them too much credit here - but there is a school of thought that this is a brilliant ploy by the SA authorities to get OP to hand over the defense arguements in a hearing that doesn't matter so they know which holes to plug come the full trial? The defence have had to launch all their big guns now to get bail.... have they kept any surprises back?

There are conflicting accounts about whether he called security and asked them to call paramedics (which is obviously slower than just calling emergency services direct).  He's reported also to have called a friend.  The prosecution were criticised for not asking whether he had a phone other than the ones they found in the apartment, and the records of calls are still to be released.

Fair enough. To be honest, the prosecution have really been poor and the defence superb this week so far, albeit I reckon Nel will go through the gears tomorrow when he rips into OP's statement.

As said above, the prosecution may be just playing a game of poker at the moment.
