tonyh29 Posted August 2, 2017 Share Posted August 2, 2017 A trademark's guiding principle is "do not confuse the consumer." .... so if it's brand that is trademarked and by trademark I guess you can include a colour , EasyJet for example could argue if you were setting up a shit airline on an orange website that you were deliberately trying to mislead people and might come after you So if you are in a similar line of business and the colour is enough to "mislead " you could be on sticky ground that said I'd probably ignore them anyway , wait for a cease and desist letter from a solicitor and then decide , I think such a letter would give you a deadline to change (assuming you didn't argue it out ) rather than meaning you'd get hit with a claim for damages from the off And , sorry to hear about your mum , hope she gets well soon Link to comment Share on other sites More sharing options...
